1. About these Terms

These Terms of Use govern access to and use of eccira.org, the official website of the Eastern Caribbean Citizenship by Investment Regulatory Authority (ECCIRA, the “Authority”). By accessing or using the website, a user accepts these Terms. Anyone who does not accept them should not use the website.

Additional terms may apply to a particular consultation, recruitment exercise, procurement, online service, publication or downloadable resource. Where those terms conflict with these, they prevail for that activity to the extent of the conflict.

2. Purpose of the website

The website gives the public access to information about the Authority and its functions. This includes official notices, legal and regulatory materials, standards and guidance, consultation documents, media releases, recruitment information, reports, publications and contact channels.

Unless a page states otherwise, website content is general information. It is not legal, financial, investment, immigration or other professional advice, and it does not replace advice given on a person’s own circumstances.

3. Official status and authoritative materials

Published materials carry a label showing their status, such as draft, consultation, guidance, standard, notice, archived, superseded or official publication, and users should take note of it. A consultation document or proposal has no final legal or regulatory effect unless and until it is formally adopted or brought into force through the applicable process.

Where website content differs from an authentic treaty, agreement, statute, regulation, standard, order, notice or other official instrument, the authentic instrument prevails. Copies published here may be reformatted or consolidated for convenience, and anyone who needs legal certainty should check the officially adopted or gazetted version.

4. Accuracy, currency and reliance

The Authority works to keep website content accurate, clear and current, but cannot guarantee that every item is complete or free from error. Regulatory requirements and official positions change, and archived material may no longer reflect current law, policy or practice.

Before acting on website content, a user should confirm its status, effective date and application to their situation and, where appropriate, take independent professional advice. The Authority is not responsible for a decision taken solely in reliance on general website information where verification or professional advice would reasonably have been required.

5. Permitted use

Subject to these Terms and to any notice attached to particular content, a user may view, download and print website content for lawful personal, professional, educational, research or other non-commercial purposes. Copies and quotations must reproduce the source accurately, acknowledge ECCIRA and preserve any copyright, status, date and disclaimer notices.

Linking to a public page is permitted, provided the link does not misrepresent the Authority, imply endorsement or present the website in a misleading context.

6. Prohibited use

A user must not:

• attempt to gain unauthorised access to the website, an account, a system, source code or data;
• interfere with the operation, security, integrity or availability of the website, including by introducing malware, excessive automated requests or denial-of-service activity;
• circumvent access controls, authentication, rate limits or other protective measures;
• scrape, harvest or extract website content at a scale or in a manner that unreasonably burdens the service, defeats a technical control or facilitates unlawful use;
• alter, misrepresent or republish content in a way that is deceptive or that obscures its status, source, date or context;
• use the Authority’s name, emblem, identity or material to impersonate the Authority or to suggest falsely that it has given approval, accreditation, affiliation or endorsement;
• submit, transmit or publish material that is unlawful, harmful, defamatory, fraudulent, infringing, confidential without authority, or otherwise contrary to applicable law; or
• use the website for any unlawful activity, or in a way that infringes the rights or legitimate interests of another person.

7. Intellectual property

Unless a page or document states otherwise, the content, design elements, databases, text, graphics and documents on this website, together with the Authority’s name, emblem and other identifiers, are owned by or licensed to the Authority and protected by applicable intellectual-property law.

No permission is given to use an ECCIRA trade mark, emblem, seal or logo in advertising, promotion, branding or domain names, or in any way that suggests endorsement or official status. Any use beyond the permissions set out in these Terms requires the Authority’s prior written consent, unless the law otherwise permits it.

8. User submissions and communications

The website does not provide public submission forms. A person who writes to the Authority using an address or channel published here is responsible for ensuring that the communication is lawful and that they are entitled to provide any information or attachment included in it.

A general contact channel should not be used to send passwords, payment-card details, sensitive personal information, confidential regulatory submissions or security credentials, unless the Authority has directed the sender to an approved secure method. Sending an email does not by itself create a confidential, advisory, contractual or representative relationship with the Authority.

9. External links and third-party services

The website may contain links to websites, documents or services operated by others. Links are provided for information or convenience and, unless stated otherwise, do not amount to endorsement or approval, or to any representation that the external content is accurate, secure or suitable.

The Authority does not control external services and is not responsible for their availability, content, security, accessibility, privacy practices or terms. Use of an external service is governed by that operator’s own terms and policies.

10. Downloads and cybersecurity

The Authority takes appropriate steps to operate a secure website, but cannot guarantee that the website or any downloadable file will always be free from malicious code, corruption or other harmful components. Users are responsible for their own devices, software, access controls, backups and security protections, and for checking downloads before use.

Suspected website vulnerabilities or security incidents should be reported promptly to info@eccira.org. A person must not exploit a suspected vulnerability or access information beyond what is needed to describe the concern.

11. Privacy

The ECCIRA Privacy Policy explains how personal information is handled through the website. By using the website, a user accepts that technical information will be processed as needed to operate, secure and maintain the service.

12. Website availability and change

The Authority may maintain, update, restrict, suspend or discontinue any part of the website where this is necessary for security, operations, legal compliance or the exercise of its functions. It does not guarantee uninterrupted availability, compatibility with every device or browser, or continued access to any particular page, feature or document.

Content may be corrected, replaced, withdrawn or archived without prior notice. Where a publication carries legal or regulatory significance, users should keep the authentic source and check whether a later version has been issued.

13. Disclaimer of warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis. The Authority gives no express or implied warranty that the website will be uninterrupted, error-free, secure or fit for a particular purpose, or that all content is complete, current or suitable for a user’s circumstances.

Nothing in these Terms limits an obligation, warranty or responsibility that cannot lawfully be excluded or limited.

14. Limitation of liability

To the fullest extent permitted by applicable law, the Authority and its officers, employees and authorised agents are not liable for loss or damage arising from access to, use of, inability to use, or reliance on the website or its content, including loss caused by interruption, delay, error, omission, malware, an external link or a third-party service.

This does not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

15. Action in response to misuse

Where the Authority believes on reasonable grounds that a user has breached these Terms, or threatens the security, integrity or lawful operation of the website, it may restrict or block access, preserve relevant evidence, notify an affected service provider or competent authority, and take any other lawful and proportionate action.

16. Governing framework and disputes

These Terms are to be read consistently with the instrument establishing the Authority and with applicable law. The law governing a particular matter, and the court or tribunal with jurisdiction over it, are determined under that instrument and the laws of the relevant participating jurisdiction. Nothing in these Terms limits any immunity, privilege, statutory protection or public-law remedy available to the Authority, or any right that cannot lawfully be excluded.

A concern about the website should first be raised with the Authority using the contact details below. Doing so does not affect any right or remedy available under applicable law.

17. Changes to these Terms

The Authority may amend these Terms to reflect changes in law, in its functions, in the website or in operational requirements. The current version and its effective date are published at eccira.org. Continued use of the website after an amendment takes effect constitutes acceptance of the revised Terms.

18. General provisions

If any provision of these Terms is held to be invalid, unlawful or unenforceable, it will be treated as modified to the minimum extent necessary or, where modification is not possible, severed, without affecting the remaining provisions. A failure or delay by the Authority in exercising a right does not waive that right.
